PJI On Track to Derail Amtrak Vaccine Policy December 13th, 2021 Media Contact: Brad Dacus, 916-616-4126 Pacific Justice Institute (PJI) has been retained by numerous Amtrak employees after Amtrak announced that its employees must receive a COVID-19 vaccine or face unpaid leave. As many as 1,000 Amtrak employees submitted requests for religious accommodation regarding the COVID-19 vaccine. In “granting” some of the requests, Amtrak has stated that these employees with religious objections, starting January 4, 2022, will be placed on unpaid leave for ninety days and that the employees cannot seek other employment during that time. Amtrak is required by law to show that mandating the vaccine is the “least restrictive means” of achieving its desired “safety” goals. There are many other ways in which Amtrak could protect its workforce from and prevent the spread of COVID-19, including mask wearing, social distancing, testing for antibodies, or COVID-19 testing. Even the recent federal order regarding vaccine mandates for private employers contemplates testing as a viable option. PJI represents Amtrak employees who have worked safely and followed COVID-19 safety protocols for well over twenty months since the start of the COVID-19 outbreak. No evidence suggests that continuing in this work environment will place other employees or passengers at a higher risk. The risk is potentially much lower now because, as stated by Amtrak CEO William J. Flynn, 88.2 percent of Amtrak workers are already fully vaccinated. Amtrak employees with granted medical accommodations are permitted to remain working on-site in their current positions, yet it appears that none of the employees with granted religious accommodations are allowed to remain in the workplace. “Amtrak is treating its employees who have requested a religious accommodation differently than those employees who have requested a medical accommodation,” stated PJI President Brad Dacus. “An ‘accommodation’ of indefinite unpaid leave, or basically being fired, is wholly unreasonable and unacceptable. We cannot stand idly by and watch strong people of faith have their religious rights deprived.” stated PJI President Brad Dacus.

BREAKING: Pacific Justice Institute Sues Los Angeles over Vaccine Mandates

PJI sues to halt City of Los Angeles from cheating employees out of religious accommodations  September 15, 2021 Media Contact: Brad Dacus, 916-616-4126 (Spanish: 206-257-3239)LOS ANGELES—Pacific Justice Institute (PJI) and affiliate attorney Daniel Watkins filed a federal lawsuit last week on behalf of Los Angeles Police Department employees to bar the City from depriving employees of their rights to seek religious accommodations to the COVID-19 vaccine mandates.   The City announced a COVID-19 vaccine mandate on August 20, 2021, for not only full-time and part-time City employees, but also individuals such as volunteers, interns, 120-day retired employees, and elected officials. The City set a deadline of September 7 for employees to submit religious accommodation requests and comply with mask requirements, physical distancing, weekly COVID-19 testing, and vaccine training.   However, neither the City nor the LAPD implemented a procedure to submit or review religious accommodation requests before the deadline, leaving hundreds of LAPD employees with no choice but to submit religious accommodation requests without direction.   The LAPD obstructed the processing of nearly half of those religious accommodation requests and has not yet processed the rest. Unvaccinated LAPD employees who sought accommodations have since endured an onslaught of hostile demands, threats of being terminated, and accusations from commanding officers, such as statements that they lack “sympathy and caring” for COVID-19 issues and that they are “unfit to wear the uniform.”   On Friday, September 10, the City at last provided an online portal for employees to submit their accommodation requests. But the City announced that the portal would close on Monday, September 13, and would not accept requests submitted outside the short 72-hour window.   “PJI stands with these LAPD employees who, instead of being provided an avenue to exercise their constitutional and statutory rights to request accommodations, were shamed and cheated out of those rights by their own Department,” stated Brad Dacus, President of PJI. “We have asked the court to require the City to respect and immediately accommodate employees who have sincerely held religious beliefs.”   PJI and Daniel Watkins of Watkins & Letofsky, LLP initiated this case, Burcham, et al. v. Breaking: PJI Sues Governor Newsom for Shutting Down Churches, Declaring Them “Non-Essential”

PJI sues Governor Newsom, challenges unconstitutional treatment of churches May 21, 2020 Media Contact: Brad Dacus, 916-616-4126 (Spanish: 206-257-3239) Sacramento, CA — Today, Pacific Justice Institute (PJI) filed a federal lawsuit against California Gov. Gavin Newsom on behalf of two churches in Calaveras County that desire to receive equal treatment, as other institutions such as schools are permitted by the Governor to reopen. The lawsuit, filed in the U.S. District Court for the Eastern District of California, seeks to restrain the Governor’s unconstitutional treatment of religious assemblies in his executive orders. Governor Newsom’s May 4 executive order, the Reopening Plan, lays out the four stages for reopening the State. Calaveras County, in the midst of Stage 2, is permitted to open schools again for educational purposes, but is forced to keep churches closed down until Stage 3. The rural churches in this case, Mountain Christian Fellowship and Refuge Church, have complied with Governor Newsom’s stay-at-home orders and did not conduct in-person services. Calaveras County reported only 13 known cases of COVID-19 and no deaths related to the virus, and the County currently has no known COVID-19 cases. Kevin Snider, Chief Counsel of PJI, who represents the churches in this lawsuit, stated, “These churches are not asking for preferential treatment from the State, but for equal treatment. No compelling state interest exists to apply different standards to a schoolhouse and a church.
